    Car sale laws

    Guys,

    Have a question.

When you purchase a car on dubizzle and go through the entire purchase process (rta check & registration, insurance etc), and the car ends up actually not working and ends up being dangerous to drive (so basically the sellers' dubizzle ad is a lie and rta failed to notice the car was a hazard), is there any law in place to let me go after the seller? Do I have a case in this country to demand the car be returned?

    Would like to know.

    Thanks

    Mike

probably, but getting a lawyer involved is probably more cost involved than the car is worth (most of the time), your best bet, is to do a PPI… once you passed over your hard earned cash, thats pretty much it.

wish i had better news for you, always, always, do a PPI unless you know what you are looking at.

what happened if i may ask?

I am sure a couple of the local guys here will jump in with a better answer than i gave..

The RTA inspection is basically a quick check to see whether the car is roadworthy or not. If you found something on your car that was checked by RTA and is actually considered hazardous (ie: they checked it wrong/made a mistake), then I guess you could go back to them and file a complaint.

However, what will then happen is they either change the report in which case your car is unsafe to be used on the roads (and you'll have to fix it) and come back later to get it re-checked or they say that it happened afterwards (or something like that) and you'll still have to fix it... So, in any case you'll have to fix it.

Regarding the seller. Yeh, he screwed you over big time. I'm not sure about the price you paid, but sometimes if something is too good to be true, it usually is. Anyway, there is probably little you can do. You were there when you bought it, you drove it, asked him questions that he satisfactorily answered and then you decided to go ahead with the purchase. The fact that the car is actually not as good as the seller promised is very unfortunate. Maybe you can give him a call and come to some sort of agreement (if he is a nice guy). Legal action is going to be a long expensive process and to be honest: it doesn't look too good for you and is probably not worth it.

I know it's too late, but let it be a warning for others. Always do a PPI (pre purchase inspection) in case you buy one of the following types of cars: German, sports car or expensive. Even more so if your car falls into more than one of these categories (like an M6!). These inspections cost about 500 AED and can save you a huge headache later on.

Keep us posted on this. Maybe some of the identified issues are not as bad or may be caused by something smaller than what the garage identified...

I posted a pic of the repair quote and briefly described some of the issues I was having in my 'new member' thread called Thread: Hey. New to Dubai. Got a 2006 E63 M6 Hartge

Learned a good lesson. This is my first time buying a car and I fell for every scam technique in the book. Found so many things to be suspicious before purchasing, but my judgement was too clouded by my love for the car to just walk away!

Hopefully I can salvage the car.

RTA are responsible for the safety condition of the car and whether it will drive you home or not. They check the suspension all round, check the brakes, lights, emergency triangle, and the tires. As far as mechanics of the car they don't care at all. The mechanics of the car is your sole responsibility and to be checked by you. This is why it is better to ask for a service history when you purchase a car and check what is changed and what is not, you'll have a clue on what is due to be changed. The only time when you need to hire a lawyer and actually file a case is when the car has been in a crash and was claimed total loss for RTA not to detect it! This is when you need to step up and actually attack. Otherwise, just sit back and hope for the best.

Now, knowing M cars, I believe this quote is kind of overdone and the real thing might be around few grands. The SMG3 had a software update from BMW that removes the juddering and the gap between gears. Like I mentioned in the other thread, our sponsor would do a good job on your car and will reveal the truth about it.

Keep us posted and good luck.

Sorry to hear about your misfortune. I'm also reading this for my future purchase protection. If you don't mind posting your resolution for others to benefit it would be appreciated.
Life is a journey. Enjoy the ride. Enjoy it in a BMW.
